Dear Mr. Modee,

HEB has been named a potential tenant in commercial properties owned by Stratus Properties in the Circle C area of southwest Austin which were recently rezoned in a development agreement between the City of Austin and Stratus.

Stratus’ tracts 103, 107, and 108 were granted variances to the citizen-initiated Save Our Springs Ordinance, specifically the strict impervious cover limit of 15% since these tracts are in the Barton Springs Recharge Zone.

I am writing you to request respectfully first that you do not choose to locate a new store in the Barton Springs Recharge Zone.

If you do elect to move forward with a new store on Stratus’ property, I request that you comply with the impervious cover limits of the Save Our Springs Ordinance – 15% or less – on the site of the store.

The citizens of Austin passed the Save Our Springs Ordinance with the intention of having it enforced. Complex political and legal questions and conflicts have at times interfered with Austin’s ability to enforce the ordinance as it is written. As a responsible corporate citizen, you have the opportunity to respect the will of the people and voluntarily comply with the ordinance.

HEB has done so before, specifically the store site on Brodie and ??? Given the increased levels of pollution in Barton Springs, as documented by the U.S. Fish and Wildlife Service, compliance with the SOS Ordinance is more important than ever.
